1. Acceptance
By creating an account or using FECFlow, you agree to these Terms of Service. If you do not agree, do not use the service. These terms apply to all subscribers, trial users, and anyone who accesses the FECFlow platform.
2. The Service
FECFlow provides a cloud-based management platform for family entertainment centers, including modules for digital waivers, bookings, point of sale, staff scheduling, reporting, and capacity management. We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.
3. Accounts and Eligibility
You must be at least 18 years old and have authority to bind your business to these terms. You are responsible for:
- Keeping your login credentials secure
- All activity that occurs under your account
- Ensuring the information you provide to us is accurate and up to date
- Notifying us immediately of any unauthorized account access at hello@fecflow.com
4. Subscriptions and Billing
- Free trial: New accounts include a 14-day free trial. No charge is made until the trial ends.
- Subscription: After the trial, a monthly subscription fee applies based on your selected modules. Billing is handled by Stripe.
- Setup fee: A one-time setup fee may apply, as shown during onboarding.
- Cancellation: You may cancel at any time from your account settings. Access continues until the end of your current billing period. No partial refunds are issued for unused time.
- Price changes: We will notify you at least 30 days before any price increase takes effect.
5. Your Data
You retain full ownership of the data you and your customers enter into FECFlow (waivers, bookings, transactions, staff records). You grant FECFlow a limited license to store, process, and display that data solely to provide the service to you.
You are responsible for obtaining all necessary consents from your customers before collecting their personal information through FECFlow's waiver, booking, or other customer-facing tools. You agree to comply with all applicable privacy and data protection laws in your jurisdiction.
6. Acceptable Use
You agree not to:
- Use FECFlow for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the service or its infrastructure
- Upload or transmit malicious code or harmful content
- Resell or sublicense FECFlow to third parties without written permission
- Use the service to collect data from individuals under 13 years of age without appropriate parental consent as required by law
7. Intellectual Property
FECFlow, its logo, software, and all associated content are owned by FECFlow. Nothing in these terms grants you any right to our intellectual property beyond what is necessary to use the service as described.
8. Uptime and Availability
We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party service outages, and circumstances beyond our control may affect availability. FECFlow is not liable for losses resulting from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, FECFlow's total liability to you for any claim arising out of or related to these terms or the service shall not exceed the fees you paid to FECFlow in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption.
10. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranty of any kind, express or implied. FECFlow does not warrant that the service will be error-free, secure, or meet all of your requirements.
11. Termination
You may terminate your account at any time from settings. We may suspend or terminate your account if you materially breach these terms, with or without notice depending on severity. Upon termination, your data is retained for 30 days and then deleted unless we are legally required to keep it longer.
12. Changes to These Terms
We may update these terms from time to time. We will notify active subscribers via email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.
